Dressmaking Academy Affiliate Program Operating Agreement

1. Parties & Acceptance

This Affiliate Program Operating Agreement (the “Agreement”) is a legal contract between Corset Academy LLC d/b/a Dressmaking Academy, a Florida limited‑liability company with its principal business address in Florida, USA (“Dressmaking Academy,” “we,” “us,” or “our”) and the individual or entity that completes the online affiliate application (“Affiliate,” “you,” or “your”).

By (a) checking the box or clicking the button that confirms your acceptance, or (b) continuing to participate in the Program after we post an updated version of this Agreement, you:

  1. agree to be bound by this Agreement;

  2. represent that you are legally able to enter into contracts; and

  3. if you are accepting on behalf of a company, warrant that you are authorized to bind that company.

 

2. Program Overview

The Dressmaking Academy Affiliate Program (the “Program”) allows affiliates to promote our courses, patterns, memberships, and other products (collectively, “Products”) using unique referral links (“Special Links”). You earn a commission (defined below) on Qualifying Purchases that occur through your Special Links during the Tracking Window (Section 7).

We operate the Program through the GoAffPro software platform. The GoAffPro user interface is provided for your convenience; however, this Agreement—not GoAffPro’s default terms—governs your relationship with us.

3. Enrollment & Eligibility

  1. Application. Complete a truthful and accurate application. You must list every website, social‑media handle, or mobile app where you will place Special Links.

  2. Approval. We may accept or reject any application in our sole discretion. We may revoke approval later if we find your site, content, or conduct unsuitable.

  3. Profile Accuracy. Keep your account information (including contact details, payment email, and promotional channels) current at all times.

 

4. Special Links & Tracking

  • After approval, your GoAffPro dashboard displays your default Special Link and a link‑builder tool.

  • Do not alter the tracking parameters. If a link is malformed or cookies are blocked, we cannot guarantee tracking or payment.

  • VIP PayPal Exception. VIP Memberships subscription (monthly and yearly) purchased via PayPal are presently un‑trackable. To ensure credit, you must use the dedicated VIP landing page that excludes PayPal buttons. Sales completed through other checkout methods are tracked normally. Lifelong memberships are tracked normally. 

 

5. Acceptable Marketing Practices

You may promote Products via blogs, social networks, email newsletters, and other lawful channels provided that you:

  • follow the Federal Trade Commission (“FTC”) endorsement guidelines (clear, conspicuous disclosure that you may earn a commission, e.g., “As a Dressmaking Academy affiliate, I may earn a commission from qualifying purchases.”);

  • comply with CAN‑SPAM for email;

  • adhere to platform rules (e.g., Facebook, Instagram, YouTube, Pinterest);

  • use only approved branding (logos, colors, typography) unless you create original assets that do not infringe our IP; and

  • never engage in:

    • spam or unsolicited bulk messages;

    • misleading or deceptive claims;

    • coupon‑code sites unless expressly authorized;

    • paid search bidding on trademarks or close variants (e.g., “Dressmaking Academy,” “Corset Academy,” “Tatiana Kozorovitsky”);

    • typo‑squatting, adware, or toolbars;

    • self‑referrals or using your own link to obtain a discount or commission;

    • sites containing adult, violent, or hate content; or

    • any illegal activity.

 

6. Responsibility for Your Properties

You are solely responsible for the development, operation, maintenance, and legal compliance of every website, social‑media profile, email list, or app that contains Special Links. You will indemnify and hold us harmless from any third‑party claims arising from your content or conduct.

 

7. Commissions (“Advertising Fees”)

RateBasis

30 % of Net SalesAll one‑time purchases and the initial payment of any subscription. Renewals are not commissionable unless we agree in writing.

  • Tracking Window. A Qualifying Purchase occurs when a customer clicks your Special Link and completes a purchase within 30 days (cookie‑based).

  • Exclusions. No commission is paid on:

    • orders canceled, refunded, or charged back (including within our 14‑day money‑back guarantee);

    • purchases made after the cookie expires or cookies are cleared;

    • purchases using un‑authorized coupon codes;

    • your own purchases or those made by an entity you control; or

    • VIP Membership subscriptions paid through PayPal (unless tracked via the dedicated landing page).

  • Adjustments. We may modify individual rates for select affiliates by mutual written agreement.

 

8. Payment Terms

  • Schedule. Payouts are issued Net‑30—on the 1st of each month for commissions earned in the previous month. Example: June sales are paid August 1.

  • Method. Payments are made via PayPal in USD to the address listed in your account. Ensure it is correct; failed payments may incur fees.

  • Threshold. No minimum payout threshold currently applies, but we reserve the right to establish one with 7‑days’ notice.

  • Refund Offsets. Commissions reversed for refunds or chargebacks will be deducted from future payouts. If your balance is insufficient, we may invoice you or charge your PayPal account.

 

9. Taxes & Documentation

You are responsible for all taxes owed on your earnings. U.S. affiliates must submit a completed IRS Form W‑9 before the first payment if total annual payouts may exceed $600. Non‑U.S. affiliates may be required to provide Form W‑8 BEN or equivalent. We may withhold payments until the required forms are received and may file Form 1099‑NEC as required by U.S. law.

 

10. Term & Termination

  • At Will. Either party may terminate this Agreement at any time, with or without cause, by written notice (including email).

  • Effects. Upon termination you must immediately remove all Special Links and cease using our trademarks. We may withhold final payments for up to 60 days to account for potential refunds.

  • Fraud. We may suspend or terminate your account immediately for suspected fraud, abuse, or violation of this Agreement, and void unpaid commissions.

 

11. Modification of Terms

We may update this Agreement, commission rates, or Program policies at any time. Changes will be posted in your GoAffPro dashboard and/or emailed to you at least 7 calendar days before they take effect (unless a change is required by law or to prevent abuse, in which case it may be immediate). Continued participation after the effective date constitutes acceptance.

 

12. Confidentiality & Data Protection

All non‑public information we share with you, including customer data, conversion statistics, or upcoming product launches, is “Confidential Information.” You will not disclose it to any third party except as required by law. You will comply with applicable privacy laws (including GDPR and CCPA) when processing any personal data.

13. Disclaimers & Limitation of Liability

The Program and all related services are provided “as is.” We make no warranties and disclaim all liability related to interruptions, errors, or lost data. Our total liability to you for any claim will not exceed the total commissions paid to you in the 12 months preceding the claim. We are not liable for indirect or consequential damages.

14. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of Florida without regard to conflict‑of‑laws rules. Any dispute that the parties cannot resolve informally must be submitted to binding arbitration in Florida under the Commercial Arbitration Rules of the American Arbitration Association. Either party may bring an individual claim in small‑claims court with jurisdiction, and either party may seek injunctive relief in any court of competent jurisdiction for intellectual‑property or confidentiality breaches.

15. Relationship of Parties

You are an independent contractor. Nothing in this Agreement creates a partnership, franchise, agency, or employment relationship. You have no authority to bind us.

16. Entire Agreement & Miscellaneous

This Agreement, together with any policies or schedules expressly referenced (e.g., commission schedule, creative guidelines), constitutes the entire agreement between you and us regarding the Program and supersedes all prior proposals or communications. If any provision is unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later.
